Persona 28 MicroSim Terms of Use

1. Acceptance

These Terms of Use are an agreement between you and Persona 28 LLC, an Indiana limited liability company ("Persona 28", "we", "us"), governing your use of the Persona 28 MicroSim.

Before starting the MicroSim, you will be asked to affirmatively agree to these Terms. By checking the acceptance box and starting the MicroSim, you agree to these Terms.

If you do not agree, please do not use the MicroSim.

2. Eligibility

The MicroSim is intended for working professionals age 18 or older.

You must be at least 18 years old to use the MicroSim.

The current pilot is offered to participants in the United States.

By using the MicroSim, you confirm that you meet these requirements, that you are using it on your own behalf, and that if you are using it in connection with your employment or engagement, you have whatever permission you need from your organization to do so.

3. This is a pilot

The MicroSim is currently offered as a pilot. That means, plainly:

  • it is being evaluated and improved while people use it;
  • the experience, the analysis, and the report may change;
  • availability is not guaranteed, and the pilot may be paused, changed, or ended at

any time;

  • your snapshot reflects the version of the MicroSim you used, and a later version

may produce a different result from the same conversation.

4. What the MicroSim is, and is not

What it is. A short simulated leadership conversation, followed by an informational Leadership Snapshot describing behavior you demonstrated during that one conversation.

What it is not — please read this part.

  • It is not a comprehensive assessment of your leadership. It observes one

short simulated interaction and reports on that.

  • It is not a psychological, clinical, or diagnostic evaluation, and it does

not diagnose or characterize you as a person.

  • It is not a prediction of your future performance in any role.
  • It is not professional advice of any kind — not employment, legal, medical,

financial, or other professional advice.

  • It is not an employment decision instrument. It should not, by itself, be

treated as a basis for hiring, firing, promotion, compensation, placement, or any other consequential decision about a person.

The analysis is AI-assisted. AI-generated analysis has limitations and may not capture every aspect of your behavior or interpret every response the same way a human reviewer would.

The snapshot is offered as a prompt for reflection and development, and should be read that way. Do not rely on the MicroSim alone for any consequential decision about yourself or anyone else.

5. Use by employers and in assessment contexts

MicroSim Pilot v1 is intended for individual leadership development.

Use of the MicroSim by an employer or other organization to evaluate individuals — whether for selection, promotion, development planning, or any other consequential purpose — is not authorized under these Terms. Such use would require different terms and different disclosures, and it is not offered here.

Nothing in this document states or implies any legal classification of the MicroSim under any particular law.

6. Permitted use

You may use the MicroSim to run a simulation and receive your own Leadership Snapshot, for your own personal and professional development.

7. Things you agree not to do

Please do not:

  • use the MicroSim to attempt to obtain, view, or interfere with anyone else's

session, result, or personal information;

  • share, publish, or attempt to use a result link that was not issued to you;
  • attempt to interfere with, disrupt, overload, or circumvent the operation of the

service or any limit, security measure, or access control we apply;

  • use automated means to create sessions, submit responses, or retrieve results;
  • scrape, harvest, or systematically extract content from the service;
  • attempt to reverse engineer, decompile, or otherwise derive the content,

methodologies, frameworks, algorithms, or software underlying the MicroSim, except where applicable law expressly permits it despite this restriction;

  • submit content that is unlawful, or that infringes or misappropriates anyone's

rights;

  • submit confidential information belonging to your employer or any third party.

The simulation does not ask for it and does not need it.

8. Persona 28 intellectual property

The MicroSim and its underlying content, methodologies, assessment and analysis frameworks, algorithms, prompts, scoring systems, designs, software, report formats, trademarks, and related intellectual property are owned by Persona 28 or its licensors, and are protected by intellectual property and other laws.

These Terms do not transfer any of that to you. You receive permission to use the MicroSim as described in section 6 and to use your own Leadership Snapshot as described in section 9, and nothing more.

9. Your responses, and your Leadership Snapshot

Your responses remain yours. Persona 28 does not claim ownership of what you write during a simulation.

Permission we need to provide the service. By using the MicroSim, you give Persona 28 permission to store, process, and analyze your responses, and to generate, store, and deliver your Leadership Snapshot from them, as described in these Terms and in our Privacy Policy — including the use of short quotations of your own words within your own snapshot.

Internal use. Persona 28 may use your responses and information generated from your use of the MicroSim internally to operate, evaluate, test, validate, secure, research, and improve the MicroSim and related Persona 28 leadership-development and assessment technology, as described in the Privacy Policy. This includes quality assurance, reviewing report quality, troubleshooting and detecting technical failures, evaluating the consistency and reliability of our analysis, validation and research work, and safety and security.

This work uses participant-level information, including information that identifies you, where that is necessary for the purpose.

Aggregate and de-identified information. Persona 28 may also create and use aggregate or de-identified information derived from use of the MicroSim for research, analysis, validation, evaluating and improving the product, assessing its reliability and performance, and describing how the product performs or is used. This is separate from, and additional to, the internal use described above.

Your snapshot. The Leadership Snapshot prepared for you is yours to read, retain, download, and share for your own personal and professional purposes. Persona 28 retains all rights in the underlying methodology, frameworks, analysis and scoring systems, report design and templates, software, trademarks, and other intellectual property used to produce it. Please do not present the snapshot as anything other than what it is (section 4), and please do not remove the notices it carries.

You confirm that you have the right to submit what you submit.

10. Availability

We do not guarantee that the MicroSim will be available, uninterrupted, timely, or error-free. We may change, suspend, or discontinue any part of it, including during the pilot, without notice.

11. Disclaimers

To the fullest extent permitted by applicable law, the MicroSim and the Leadership Snapshot are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

Persona 28 does not warrant that the analysis or the snapshot is accurate, complete, or suitable for any particular purpose, and section 4 describes what the snapshot is and is not.

Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

12. Limitation of liability

To the fullest extent permitted by applicable law, Persona 28 LLC will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or relating to your use of the MicroSim or your Leadership Snapshot, even if Persona 28 has been advised of the possibility of those damages.

To the fullest extent permitted by applicable law, Persona 28 LLC's total aggregate liability arising out of or relating to the MicroSim, the Leadership Snapshot, or these Terms will not exceed the greater of (a) $100 or (b) the amount you paid Persona 28 for use of the MicroSim during the twelve months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.

13. Suspension and termination

We may suspend or end your access to the MicroSim if we reasonably believe you have breached these Terms, or to protect the service, other participants, or Persona 28.

You may stop using the MicroSim at any time.

Sections that by their nature should survive — including sections 8, 9, 11, 12, and 14 — survive termination.

14. Governing law and venue

These Terms, and any dispute arising out of or relating to them, the MicroSim, or the Leadership Snapshot, are governed by the laws of the State of Indiana, without regard to its conflict-of-laws principles.

Any legal action or proceeding arising out of or relating to these Terms, the MicroSim, or the Leadership Snapshot must be brought in a state or federal court located in Indiana, and you consent to the personal jurisdiction and venue of those courts.

15. Changes to these Terms

We may update these Terms. When we do, we will change the effective date at the top and the version identifier below. Where a change is material, we will take reasonable steps to bring it to the attention of participants, and continued use after a change means you accept the updated Terms.
